Terms of Service

1. Acceptance of Terms

By registering an account on JUZAFY, you ("the Organisation" or "Account Holder") agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, you may not use this platform.

These terms apply to all users of the platform including administrators and system users registered under an organisation account.

2. Description of Service

JUZAFY is a cloud-based group management and communication platform provided by TELESOFT. The platform enables organisations to:

• Register and manage group members
• Track pledges and financial contributions
• Send SMS notifications to members via the Beem Africa gateway
• Schedule and automate SMS reminders
• Generate reports and maintain audit trails

Access to the platform is subject to approval by the JUZAFY system administrator after registration.

3. Account Registration & Approval

When you register an organisation account:

• You must provide accurate and truthful information about your organisation
• Your account will remain in a pending state until reviewed and approved by JUZAFY administration
• JUZAFY reserves the right to reject any registration without providing a reason
• You are responsible for maintaining the confidentiality of your login credentials
• You must immediately notify JUZAFY of any suspected unauthorised access to your account

4. Your Responsibilities as Account Holder

4.1 Member Data Consent

You must obtain valid, informed consent from every individual whose personal data (name, phone number, financial information) you enter into the platform before doing so. JUZAFY is a tool — the legal obligation to obtain consent rests with you.

4.2 Lawful Use

You agree to use the platform only for lawful purposes. Specifically, you must not:

• Enter data of individuals without their consent
• Send unsolicited or deceptive SMS messages
• Use the platform to harass, threaten, or harm any individual
• Attempt to access data belonging to other organisations
• Circumvent any security or access controls of the platform

4.3 SMS Responsibility

All SMS messages sent through the platform originate from your organisation. You are solely responsible for the content of every SMS message sent to your members. JUZAFY provides the delivery mechanism only.

5. SMS Credits & Billing

• SMS credits are purchased in advance and are non-refundable once consumed
• Credits are credited to your organisation account only and cannot be transferred
• JUZAFY uses the Beem Africa SMS gateway; delivery depends on carrier availability and is not guaranteed
• Failed messages due to invalid numbers or network issues will still deduct a credit

6. Account Suspension & Termination

JUZAFY may suspend or terminate your account at any time if:

• You violate these Terms of Service
• Your account is involved in fraudulent, illegal, or abusive activity
• You fail to comply with data protection obligations
• JUZAFY determines, in its sole discretion, that suspension is necessary

Upon termination, you may request export of your data within 30 days before it is permanently deleted.

7. Limitation of Liability

JUZAFY is provided "as is" without warranties of any kind. To the maximum extent permitted by law:

• JUZAFY is not liable for SMS delivery failures caused by third-party gateways
• JUZAFY is not liable for any data loss, however caused
• JUZAFY's total liability shall not exceed the amount paid by you in the preceding 3 months

8. Changes to These Terms

JUZAFY may update these Terms at any time. Continued use of the platform after changes constitutes acceptance of the new terms. We will notify active organisations of material changes via in-platform notification.

9. Governing Law

These Terms are governed by the laws of the United Republic of Tanzania. Any disputes shall be resolved in the courts of Tanzania.
